General Terms and Conditions Tenancy Agreement Unless otherwise stated, properties are let on Assured Shorthold Tenancy Agreements for an initial term of six months. Longer periods can be agreed by negotiation. At the end of the period of six months, then unless Notice is served by the Landlord for possession of the property (this is the exception rather than the rule), the Tenancy continues on a month to month or “periodic” basis. Inventory On completion of the Tenancy Agreement, the Tenant will be given an Inventory that lists any contents supplied with the property and comments on the general condition. This then forms a record of the property and its contents as at the start of the lease for the benefit of both parties. Rent Payments Rent is payable monthly in advance. The first payment is made on completion of the Tenancy Agreement. Subsequent payments are made by standing order on the corresponding day of the following month. Deposit A Deposit is paid on completion of the agreement. Under the terms of the Tenancy Agreement, Tenants are not responsible for the normal wear and tear of the decorations or furnishings. They are responsible, however, for any damage caused. The Deposit is held as security against the Tenant’s obligations under the terms of the lease, including damage or cleaning required at the end of the lease. If you have complied with the terms of the Tenancy Agreement, the Deposit will be returned in full following your vacation of the property. Otherwise, the balance of the Deposit will be returned once the work has been carried out or items purchased. Household Bills Tenants are responsible for the payment of all utility charges associated with the property throughout the period of their tenancy (including gas, electricity, and water bills, Council Tax, TV licence, telephone and internet bills). The Tenant must not change the supplier of the gas or electricity without prior written consent. Insurance The Tenant is responsible for maintaining insurance on his/her own belongings. CP Walker and Son’s Insurance Department offer Home Contents Insurance and will be able to provide a competitive quote if required. Repairs The Tenant is responsible for keeping the interior of the property in good and clean condition and repair (subject to the principles of fair wear and tear). The Landlord is responsible for the repair of the structure and exterior (including drains, gutters and external pipes), the installations for the supply of water, gas, electricity and sanitation and the central and water heating systems. Inspection The Landlord or their Agents will carry out periodic inspections of the property during the period of the Tenancy to monitor care. Pets Tenants are not normally allowed to keep either dogs or cats in rented properties. Prospective Tenants that have pets should check with the Landlord prior to completing a Tenancy Application Form. Gardens Tenants are responsible for maintaining any gardens supplied with a property. Unfurnished, Part Furnished or Furnished Unless otherwise stated, properties are let in the condition and with the contents seen. Repairs excepted, the Landlord will not carry out work to the premises or supply and additional furniture once the property has been let. Gas Appliances All gas appliances supplied with the property will be tested on an annual basis. A copy of the Test Certificate will be provided on completion of the Tenancy Agreement and Gas fittings are tested on an annual basis. Electrical Appliances Unless otherwise stated prior to the start of the Tenancy, the Landlord will maintain any electrical items that are supplied with the property. Notice to Terminate A Tenant is required by law to give not less than one month’s notice to terminate a periodic tenancy. The end date of the lease is the last day of any rent period (i.e. if rent is paid on the 5th of the month, the Tenant must give a month’s notice from before the 5th of the month to expire on the 4th day of the following month). If you are unsure about the amount of Notice you have to give, contact this office. If a Landlord wishes to terminate the tenancy, he or she is required to give not less than 2 month’s notice on the same basis as above. Legally it is not possible to give notice during a fixed term tenancy. However, if your circumstances do change and you wish to leave before the end of the initial fixed term, you should contact this office. The Landlord may well be willing to re-market the property and release you from the tenancy once a new Tenant has been found. |
